Notice of SaleC/A No: 2011-CP-44-0508BY VIRTUE OF A DECREE of the Court of Common Pleas for Union County, South Carolina, heretofore issued in the case of Central Mortgage Company against, Robert H. Cato, and Jennifer Cato, I the undersigned as Special Referee for Union County, will sell on July 7, 2014, at 11:00 o'clock, at the Union county courthouse in Union, South Carolina, to the highest bidder:Legal Description and Property Address:ALL OF THAT CERTAIN piece, parcel, or lot of land with any improvements thereon lying, being, and situate on the southern side of S. C. Road 44-86 in Santuc Township, Union County, South Carolina, containing 6 acres, more or less, and being a part of an 11.79 acre, more or less, lot that is shown on a plat prepared for James E. Magner by Mike W. Byers, RLS, on July 2, 1981. Said lot has the following metes, bounds, directions, and distances, to wit: Beginning at a point (nail and cap) in the S. C. Road S 44-86 thence N 72-00 E for a distance of 184.54 feet, more or less, to nail and cap; thence S 81-44 E along Magner Drive for a distance of 155.0 feet, more or less, to a point; thence S 71-38 E for a distance of 97.83 feet, more or less, to a point; thence S 61-24 E for a distance of 111.16 feet, more or less, to a point; thence S 63-02 E for a distance of 106.19 feet, more or less, to a point; thence S 70-00 E for a distance of 100.0 feet, more or less, to a point; thence S 74-23 E for a distance of 154.21 feet, more or less, to a point; thence S 77-05 E for a distance of 45.83 feet, more or less, to RR set; thence S 18-13-56 W for a distance of 566.29 feet, more or less, to a point; thence N 44-38 W for a distance of 1004.48 feet, more or less, to the point of beginning. Said lot is bounded on the north by the said Magner Drive; on the east by a 2.659 acre lot now or formerly of Pearl M. Magner; on the south by property now or formerly of Lewis W. Cadweallader, et al; and on the northwest by the said S. C. Road S 44-86.THIS BEING the same property conveyed unto Robert H. Cato by virtue of a Deed from Shannon B. Foster, dated June 30, 1998 and recorded June 30, 1998, in Deed Book 217 at Page 985, in the Office of the Clerk of Court for Union County, South Carolina.THEREAFTER, Robert H. Cato conveyed subject property unto Robert H. Cato and Jennifer Cato by virtue of a Deed dated December 30, 2003 and recorded January 12, 2004, in Deed Book 227 at Page 793, in the Office of the Clerk of Court for Union County, South Carolina.520 Strother Road, Union, SC 29379TMS#: 107-00-00-066TERMS OF SALE: For cash. Interest at the rate of 4.375 % to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, do, upon the acceptance of his or her bid, deposit with the Special Referee for Union County a certified check or cash in the amount equal to five per cent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within 30 days, the Special Referee shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. If the Plaintiff or the Plaintiff's representative does not appear at the above-described sale, then the sale of the property will be null, void, and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale.
