NOTICE OF SALE Docket No. 2014-CP-44-36 By virtue of a decree heretofore granted in the case of Branch Banking and Trust Company of South Carolina n/k/a Branch Banking and Trust Company against Ivey's Home Furnishings, Inc., I, the undersigned Special Referee for Union County, will sell on Tuesday, July 1, 2014, at 11:00 A.M. at the Union County Courthouse, 210 W. Main Street, Union, South Carolina, to the highest bidder: All of those certain pieces, parcels or lots of land with any improvements thereon, lying, being and situate in Santuck Township (1/4 mile east of Brown's Creek Church) in Union County, South Carolina, and being shown as Lots A and B, Lot A containing 1.017 acres, more or less, and Lot B containing 0.957 acre, more or less, on a Plat prepared for John R. Frazier, Inc. by Thomas D. Sherbert, Jr., RLS, with field work by A. P. Dill, Jr., on October 28, 1977 as being a portion of John Frazier's "William D. Palmer Tract" as shown on a plat by Dan Collins dated April 1969. Said lots in the aggregate have the following metes and bounds, to wit: Beginning at I. N. at S. C. Highway No. 49 (corner to property being reserved by John R. Frazier, Inc.) thence S 84° 25' 47" E for a distance of 290.0 feet to I. N.; thence S 48° 51' W for a distance of 450.0 feet O. A. to I. N. at the Center of Old Ferry Road the line; thence N 64° 29' W for a distance of 60.0 feet to I. N.; thence N 75° 30' W for a distance of 75.0 feet to I. N.; thence N 82° 20' W for a distance of 125.0 feet to Nail and Cap; thence N 50° 19' E for a distance of 300.0 feet to I. N.; thence N 44° 27' E for a distance of 100.0 feet to I. N. the point of beginning. Said property is bounded on the northwest by S. C. Highway No. 49, on the north and southeast by property now or formerly of John R. Frazier, Inc. and on the southwest by property now or formerly of Robert Baldwin and the said Old Ferry Road. This is the same property conveyed from Glenn R. Ivey to Ivey's Home Furnishings, Inc. by deed recorded in Deed Book 230 at page 678. TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at the conclusion of the bidding, Five per cent (5%) of the bid in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder.) As a deficiency judgment is demanded, the bidding will remain open for a period of 30 days after the date of sale as provided by law in such cases. Plaintiff may waive any of its rights, including its right to a personal or deficiency judgment, at any time prior to the foreclosure sale.
